I was thinking of tying this into the Human Rights thread below, but figured this item deserved a post of its own.
Holden at First Draft blogs a nice summary of yesterday's court decision in favor of Jose Padilla. I expect the Bush administration to appeal to its last breath, even if it takes an "aye" vote from Scalia to overturn this decision.
Let it be known far and wide that I am not defending dirtbag Jose Padilla. I'm defending constitutional principals that are not subject to willy nilly executive branch interpretation to fit the boogeyman of the day.
Either charge him and give him his day in court, or let him free. There's no middle ground for an American citizen in America.
The Bush-appointed judge got it right.
